The Kroger Co., Inc. has petitioned the Â鶹´«Ã½ Trade Commission to reopen and set aside a 1969 order that prohibits Kroger from knowingly inducing, receiving or accepting any discrimination in the net price of fluid milk and other dairy products, or accepting from any seller a net price that Kroger knows or should know is below the net price at which similar products are being sold to Kroger's competitors. Kroger submitted the petition pursuant to the FTC's "sunsetting" policy for competition orders, under which the FTC presumes the public interest requires setting aside such orders when they are more than 20 years old. The petition will be subject to public comment for 30 days, until Jan. 2, 1996
Kroger is based in Cincinnati, Ohio.
Comments on the petition should be addressed to the FTC, Office of the Secretary, 6th Street and Pennsylvania Avenue, N.W., Washington, D.C. 20580.
