Stryker and Wright Medical; Analysis of Consent Orders To Aid Public Comment

On October 21, 2019, the FTC announced it had halted the deceptive online marketing tactics of cosmetics firm Sunday Riley Modern Skincare, LLC and its CEO. Under the order settling the FTC’s complaint the defendants were banned from misleading consumers by posting fake reviews of the company’s products on a major retailer’s website, at the CEO’s direction, and by failing to disclose that the reviewers were company employees. The FTC announced approval of the final order in November 2020.

Pharmaceutical companies AbbVie Inc. and Allergan plc have agreed to divest assests to settle Â鶹´«Ã½ Trade Commission charges that AbbVie's proposed $63 billion acquisition of Allergan would violate federal antitrust law. On Sept. 4, 2020, the Commission announced the final consent agreement in this matter.

The Â鶹´«Ã½ Trade Commission filed suit against Zaappaaz, the operators of wrist-band.com and other online storefronts, for failing to deliver on promises that they could quickly ship products like face masks, sanitizer, and other personal protective equipment (PPE) related to the coronavirus pandemic.
The lawsuit alleges that the company violated the FTC’s Mail, Internet and Telephone Order Rule (Mail Order Rule), which requires that companies notify consumers of shipping delays in a timely manner and give consumers the chance to cancel orders and receive prompt refunds.

The Â鶹´«Ã½ Trade Commission issued an administrative complaint alleging that Benco, Henry Schein and Patterson, the nation's three largest dental supply companies, violated U.S. antitrust laws by conspiring to refuse to provide discounts to or otherwise serve buying groups representing dental practitioners. These buying groups sought lower prices for dental supplies and equipment on behalf of solo and small-group dental practices seeking to gain discounts by aggregating and leveraging the collective purchasing power and bargaining skills of the individual practices. The complaint also alleges an FTC Act Section 5 violation against Benco for inviting a fourth competing distributor to join the conspiracy.
